ComputeGuy Terms of Service

Welcome to ComputeGuy! These Terms of Service (“Terms”) govern your access to and use of our Virtual Private Server (VPS) services (the “Services”) provided by ComputeGuy (“we,” “us,” or “our”). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Acceptance of Terms
By accessing or using the Services, you affirm that you are at least 18 years old and capable of entering into a legally binding agreement.
2. Description of Services
ComputeGuy provides VPS hosting services, including but not limited to server provisioning, maintenance, and support. The specific features and capabilities of the Services are described on our website.
3. Account Registration
To use our Services, you must create an account. You agree to provide accurate and complete information during the registration process and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:
- Violating any applicable local, provincial, national, or international law or regulation.
- Engaging in any activity that disrupts or interferes with the Services or the servers and networks connected to the Services.
- Using the Services to distribute, publish, or store any content that is unlawful, defamatory, obscene, or otherwise objectionable.
5. Fair Usage Policy
For our unmetered services, ComputeGuy operates a fair usage policy to ensure that all users have a high-quality experience. While we do not impose strict data limits on our unmetered services, we reserve the right to review and manage excessive usage patterns that may adversely affect the performance of our infrastructure or the experience of other users.
Prohibited activities under this policy include, but are not limited to:
- Using the Services for high-volume automated data transfers or continuous, excessive bandwidth usage that negatively impacts other users.
- Running public-facing services that generate a disproportionately high amount of traffic.
- Engaging in any activities that violate the spirit of fair usage, as determined at our sole discretion.
If your usage significantly exceeds the average usage of other users, we reserve the right to throttle your bandwidth automatically without notification, limit, suspend, or terminate your access to the Services to protect the overall integrity and performance of our network.
6. Payment and Billing
You agree to pay all fees associated with your use of the Services in accordance with our pricing and payment terms, which are available on our website. All fees are non-refundable unless otherwise stated. We reserve the right to change our fees at any time, with notice provided to you.
7. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting our customer support. Upon termination, your right to use the Services will immediately cease.
8. Limitation of Liability
To the fullest extent permitted by law, ComputeGuy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services.
9. Indemnification
You agree to indemnify, defend, and hold harmless ComputeGuy and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on our website. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
